Terms of Service

Welcome to Orbyt, a social-news and discussion platform operated byAxis 80 Interactive Communications, Inc. (“Operator,” “we,” “our,” or “us”). These Terms of Service (“Terms”) form a binding contract between you (“you,” “your,” or “User”) and Operator. By accessing or using Orbyt (the “Service”), you agree to the Terms.

Note for EU/EEA/UK residents: Orbyt is currently not offered in your region; account creation and access are geo-blocked. If you circumvent these blocks, you do so at your own risk and we disclaim all warranties and responsibilities that would otherwise arise under EU/UK law.

1. Eligibility

• You must be at least 13 years old and legally capable of entering a contract.
• Parental consent accounts are not supported; Users under 13 are prohibited.
• You represent that you are not barred from using the Service under any applicable laws.

2. Privacy & Cookie Policies

Our Privacy Policy and Cookie Policy explain how we collect, use, share, and retain information. By using Orbyt, you acknowledge those policies.

3. Your Account

• You are responsible for maintaining the confidentiality of your credentials. If you suspect unauthorized use, immediately (a) reset your password and (b) notify us at security@orbyt.social. We may require additional verification before we disable or transfer control of an account.
• Deletion: You may delete your account at any time in Settings. After deletion it will be deactivated for 30 days, during which you may reactivate by logging in. After 30 days we will permanently remove personal data except where retention is required for security, legal, or moderation reasons.

4. User-Generated Content (“UGC”)

Orbyt is built on content that Users submit (“Content”). You retain ownership of your Content. However, by posting, you grant Operator a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to host, store, reproduce, adapt (solely for formatting/display), publicly display, distribute, and promote that Content in connection with the Service and its marketing.

5. Prohibited Conduct

• Violation of the Community Guidelines, including spam, harassment, violent or illegal content.
• Posting, sharing, or creating communities for adult content, sexually explicit material, pornography, or sexual services.
• Attempting to evade bans or interfere with the Service's normal operation.
• Using automated means (bots, scrapers) without written permission.
• Posting Content that infringes intellectual-property or privacy rights.

6. Moderation & Enforcement

Volunteer community moderators set and enforce rules for their communities. Operator may remove Content, suspend accounts, or impose platform-wide bans in its sole discretion. We are not obligated to explain moderation decisions but may provide a brief rationale.

7. Intellectual Property of Operator

The Service, logo, and associated marks are the property of Operator. Except for the limited license under Section 4, these Terms do not grant you rights to our IP.

8. Third-Party Links & Advertising

The Service displays banner advertising from networks such as ExoClick. We are not responsible for third-party sites or products. Interactions with advertisers are solely between you and them.

9. Disclaimers

• The Service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not control, endorse, or take responsibility for any UGC.
• We make no guarantees of uptime or error-free operation.

10. Limitation of Liability

To the fullest extent permitted by law, Operator, its affiliates, and officers will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Service. Our total liability will not exceed the greater of (a) USD 50 or (b) the amount you paid us (if any) in the past 12 months.

11. Indemnity

You agree to indemnify and hold harmless Operator from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your Content or your breach of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law principles. Any permitted court proceedings shall be brought exclusively in the state or federal courts located in Frederick County, Maryland.

13. Dispute Resolution & Arbitration

Mandatory Arbitration. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS pursuant to its Streamlined Rules. You and Operator waive the right to a trial by jury.

Small-Claims Exception. Either party may pursue an individual claim in small-claims court in Frederick County, Maryland.

14. Class-Action Waiver

You agree that any claims will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Termination

We may suspend or terminate your access at any time for any reason. The license you grant (Section 4) and Sections 8–15 survive termination.

16. Changes to These Terms

We may update these Terms periodically. We will post changes on this page with a new “Last updated” date and, if changes are material, provide additional notice. Continued use after an update constitutes acceptance.
